Agreement to Terms
By accessing or using FogIndex ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
Description of Service
FogIndex is a fog forecasting service designed for landscape photographers and outdoor enthusiasts. The service provides:
- Fog likelihood predictions based on weather data and a proprietary algorithm
- Customizable alerts for locations you monitor
- Daily digest emails with fog forecasts
Important: FogIndex provides forecasts for informational purposes only. Weather predictions are inherently uncertain, and accuracy cannot be guaranteed.
Account Requirements
Creating an Account
- You must be at least 13 years old to use FogIndex
- You must provide accurate and complete information
- You are responsible for maintaining the security of your account credentials
- You must not share your account with others
Account Limits
- Free users: Up to 3 monitored locations
- Tester users: Up to 3 monitored locations
- Pro users: Up to 10 monitored locations
- Admin users: Up to 10 monitored locations
Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the service's systems
- Interfere with or disrupt the Service
- Scrape, crawl, or harvest data using automated tools
- Resell or redistribute the forecasts without permission
- Create multiple accounts to bypass usage limits
- Reverse engineer the forecasting algorithm
Weather Forecasts and Disclaimers
No Guarantees
- Weather is unpredictable - Forecasts are estimates based on available data
- Not a substitute for official sources - Consult official weather services for critical decisions
- No liability for inaccuracy - FogIndex is not responsible for missed opportunities or travel decisions
- Algorithm changes - The algorithm is continuously improved, which may affect results
Notifications and Communications
Alert Delivery
- FogIndex strives to deliver alerts promptly, but cannot guarantee delivery times
- Alerts may be delayed or fail due to technical issues
- You are responsible for ensuring your contact information is correct
Service Availability
The Service is provided "as is" and may be unavailable due to:
- Maintenance and updates
- Technical issues
- Third-party service outages
- Force majeure events
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "as is" without warranties
- FogIndex is not liable for inaccurate forecasts, missed fog events, failed notifications, service outages, or any consequential damages
- Your sole remedy for dissatisfaction is to stop using the Service
Termination
By You
- You may delete your account at any time through settings
- Upon deletion, your data will be removed within 30 days
By Us
Your account may be suspended or terminated if you violate these Terms, abuse the Service, or create legal risk.
Changes to Terms
These Terms may be updated from time to time. You will be notified of material changes by email or website notice.
Your continued use after changes constitutes acceptance. If you disagree, stop using the Service and delete your account.
